Ahmaud Arbery

As the well-documented facts in court records, video, and 911 calls show, Greg McMichael (Navy Veteran and 30 years in law enforcement with no complaints) and Travis McMichael (Coast Guard Veteran and had the highest security clearance in the nation to work on nuclear submarine base) were fully complying with Georgia law (e.g. OCGA 17-4-60 (note the word "suspicion")) when Ahmaud Arbery (a repeatedly convicted felon whose own mother called 911 on him and warned law enforcement that her son had a "mental condition" that had "escalated" over time and that he might get "violent" if confronted) got shot while he was violently attacking, beating, and FOOLISHLY trying to take the loaded shotgun by the barrel away from Travis, which gave Travis no other option than to defend himself while being attacked and beaten by Ahmaud Arbery, who was never threatened or even touched while they were waiting for the police to arrive.
Note too that in 2019 and 2020, local convenience store witness interviews reveal that Ahmaud Arbery became known as "the jogger" for his repeated conduct and behavior of running up, stretching in front in, and then entering several convenience stores where he would grab items and run out before he could be caught.

a. Evidence of Ahmaud Arbery's deteriorating mental health as witnessed by family members, neighbors, and his probation officer, leading to the probation officer's directive that Ahmaud Arbery get mental health evaluation at Gateway Behavioral Health ("Gateway") on December 18, 2018.
b. The information Ahmaud Arbery provided to the mental health evaluator concerning his auditory delusions sometimes commanding him "to rob and steal" and sometimes telling him "to hurt people," his combative tendencies, his anger, and his difficulty in situations inside and outside his home.
c. Evidence from Ahmaud Arbery's mental health evaluators, who on December 18, 2018, diagnosed him with Schizoaffective Disorder
Note too that the above crucial relevant evidence, and much more, was deliberately and unjustly withheld from the jury, which was intimidated by angry mobs of BLM activists threatening to riot and yelling "No Justice!, No Peace!" and "Burn it down!" just outside the courthouse where the jury clearly heard and were obviously concerned by those threats and demands.

The McMichael case is virtually identical to that of Kyle Rittenhouse who was also attacked and beaten while his attackers also FOOLISHLY tried to take the loaded gun away from Kyle, which also gave Kyle no other option than to defend himself while being attacked and beaten and could have been murdered by his attackers, all convicted felons.
However unlike Kyle, Travis had personally seen his attacker trespassing days earlier when his attacker appeared to be pulling a gun on Travis when Travis then called 911.
That serious threat gave Travis and Greg justified reason to bring their legally-carried guns with them when Greg also called 911 on that suspect as they waited for the police to arrive and never threatened or even touched that suspect, Ahmaud Arbery.

Georgia Law

BEFORE continuing, it is crucial that the Official Code of Georgia Annotated (OCGA) Laws that apply to the Ahmaud Arbery case be read and understood.
Those applicable laws are listed below and are provided in the file
AhmaudArbery_DistrictAttorney.pdf.

OCGA 17-4-60 (note the word "suspicion" as underlined below):

A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge.
If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion.
OCGA 16-11-126:
(a) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a weapon or long gun on his or her property or inside his or her home, motor vehicle, or place of business without a valid weapons carry license.
(b) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a long gun without a valid weapons carry license, provided that if the long gun is loaded, it shall only be carried in an open and fully exposed manner.
OCGA 16-3-21:
Use of Force in Defense, once confronted with a deadly force situation an individual is allowed to use deadly force to defend themselves or others.
OCGA 16-3-23.1:
Georgia's No Duty to Retreat Law, an individual is not required to back away from or submit to an attack.
OCGA 16-3-24:
(b) The use of force which is intended or likely to cause death or great bodily harm to prevent trespass on or other tortious or criminal interference with real property other than a habitation or personal property is not justified unless the person using such force reasonably believes that it is necessary to prevent the commission of a forcible felony.
OCGA 16-3-24.2:
A person properly and legally defending themselves is immune from prosecution.

Withholding Evidence

A judge may NOT keep the character of a suspect from being placed into evidence if others involved KNEW about that character at the time of the incident.
Travis KNEW that Ahmaud Arbery (i.e. "the suspect") was a trespasser and
Travis KNEW that that "the suspect" was a serious threat because
Travis personally SAW "the suspect" trespassing who then appeared to be pulling a gun out of his pocket, which is when
Travis CALLED 911 about "the suspect" with a possible gun.

And that's not all.
Greg and Travis and several others in the neighborhood saw "the suspect" in person and on several surveillance camera videos trespassing where thousands of dollars of items were stolen.
The neighborhood even had a Facebook page about "the suspect".
When the police came to where "the suspect" was seen trespassing several times, the police had their guns drawn for protection from "the suspect" with a possible gun.
Therefore, it was "reasonable" for Greg and Travis to suspect that "the suspect" was a burglar and it was "reasonable" for Greg and Travis to bring their guns to protect themselves because they had justified reason to believe that "the suspect" may have had a gun, which very well could have been the same gun that was stolen from Travis's truck earlier.
Even the mother of "the suspect" had called 911 on him and warned law enforcement that "the suspect" had a mental condition that had escalated over time making him violent if confronted. And that is precisely what happened when "the suspect" violently attacked Travis, who had "confronted" but never threatened or even touched "the suspect", as clearly seen in the video.

The list below is just a sample of the crucial relevant evidence that the judge unjustly and deliberately withheld from the jury, which was intimidated by angry mobs of BLM activists threatening to riot and yelling "No Justice!, No Peace!" and "Burn it down!" just outside the courthouse where the jury clearly heard and were obviously concerned by those threats and demands.

  1. The judge withheld Ahmaud Arbery's criminal history of arrests, convictions, threats against police (e.g. "Bitch you hit me with that shit, bitch, you gonna be fucked up."), 911 calls against him (even by his own mother who warned law enforcement that he had a "mental condition" that had "escalated" over time and that he might get "violent" if confronted), that convenience store witnesses had named him "the jogger" for his repeated conduct and behavior of running up, stretching in front in, and then entering several convenience stores where he would grab items and run out before he could be caught, and much more.
  2. The judge withheld Ahmaud Arbery's documented history of mental illness and being diagnosed with Schizoaffective Disorder.
    In December 18, 2018 Ahmaud Arbery underwent a mental health examination at Gateway Behavioral Health Services in Brunswick, Georgia where he was diagnosed with Schizoaffective Disorder with command hallucinations that he says sometimes told him "to rob and steal" and "to hurt people".
    Ahmaud Arbery was prescribed medication, but there is no evidence that he followed up with scheduled appointments.
    Note that probation and mental records are not publicly accessible; however, a review of the records received during discovery phase of the case exposed those facts.
    Ahmaud Arbery was not being treated for his mental illness on February 23, 2020, when he charged Travis and struggled for control of the shotgun.
    The judge's unjust decision to keep this out of the trial meant that the jury could not hear medical evidence from a defense expert in the field of forensic psychiatry that Ahmaud Arbery's actions in charging Travis and fighting for control of a shotgun could be expected from someone suffering Schizoaffective Disorder.
  3. The judge withheld evidence to show that the Satilla Shores neighborhood and adjacent Royal Oaks neighborhood had lived under the perception of crime being out of control in the months before Ahmaud Arbery's death. Police reports, 911 calls, social media posts, and the like supported the fact that neighborhood residents were in a constant state of fear, in part because of the videos of Ahmaud Arbery seen snooping around private property.
    Note that records would show a dramatic drop in 911 calls for police services to these neighborhoods after Ahmaud Arbery got killed while attacking Travis.
  4. The judge unjustly withheld testimony from a firearms expert to explain Travis' actions in handling the shotgun, weapon retention, etcetera, was consistent with his training and experience while serving in the U.S. Coast Guard.
That judge, who withheld crucial relevant evidence from the intimidated jury, then sentenced those completely innocent men (who were fully complying with Georgia law) to LIFE in prison without the possibility of parole.

Video Evidence Of The Incident

The video below clearly shows that Travis McMichael, his father Greg McMichael, and neighbor William "Roddy" Bryan literally and physically never ever even touched Ahmaud Arbery as they were simply following Ahmaud Arbery till the police arrived.
But Ahmaud Arbery chose to run to the left (instead of the right) and attack, beat, and FOOLISHLY tried to take the loaded shotgun by the barrel away from Travis, which gave Travis no other option than to defend himself while being attacked and beaten and could have been murdered by Ahmaud Arbery, a repeatedly convicted felon.

The video at the link below, at the time tagged, shows Ahmaud Arbery being arrested after getting caught running away from the police after trespassing in a mobile home, while smoking marijuana, while "contributing to the delinquency of a minor", and once again claiming that he was only out "running".
While Ahmaud Arbery is handcuffed in the back seat of the police car arguing with and yelling at the police, the (black) police officer slams the door in Ahmaud Arbery's face, not once, but twice.

The following crimes that the jury never heard about Ahmaud Arbery are included in Glynn County, Georgia Court Documents and in the file AhmaudArbery_Crimes.pdf:

  1. On March 14, 2013, security camera Video from South Georgia Technical College reveals Mr. Arbery provided friend pair of wire cutters to use as a weapon as he, the friend, and others waited for another group of men to appear. When the other group arrived, Mr. Arbery and the others engaged in a violent fight;
  2. On December 3, 2013, Glynn County Police reports reveal Mr. Arbery unlawfully concealed handgun into his waistband and tried to gain admission into high school basketball game. Officers noticed the butt of the gun protruding from his waistband and ordered for him to stop. Mr. Arbery ran from police, which resulted in two officers sustaining injuries: one because Mr. Arbery scratched his arm to get away; the other because the officer fell and sustained injuries during his chase of Mr. Arbery. Also, the Chief of Police reported that as he chased Mr. Arbery in his vehicle, Mr. Arbery reached into his waistband as if searching for his firearm. Police eventually surrounded Mr. Arbery and charged him. He was later convicted for several felony and misdemeanor charges, including gun possession and obstruction;
  3. On October 7, 2017, Glynn County Police body cam video reveals an officer spotted sole car parked in park area known for drug activity. The officer could not see who was in the car due to the occupant being inside the car and the car having tinted windows. When he approached the car, the occupant, Mr. Arbery, got out. The officer asked Mr. Arbery for his ID. Within minute and thirty seconds of the officer holding Mr. Arbery's license to check his background, Mr. Arbery said, "Nobody not even driving the car. What the fuck you coming over here for? The fuck you come over here and fuck with me for?" When the officer began to explain his purpose to Mr. Arbery, Mr. Arbery quickly changed his conduct, launched forward at the officer, crossing several feet to confront the officer, and threw out his arms. The officer had to put his arm out to stop Mr. Arbery from colliding with him. Mr. Arbery cursed the officer and then told the officer, "Bitch you hit me with that shit, bitch, you gonna be fucked up." This caused the officer to tell Mr. Arbery he was going to search him for weapons and second officer to attempt to use taser on Mr. Arbery. He was not arrested;
  4. In June of 2018, 911 audio reveals Mr. Arbery's mother, Wanda Jones, called 911 due to Mr. Arbery's refusal to give Ms. Jones her car keys. She made the call from inside her car while Mr. Arbery stood outside her car. During her call to 911, she cautioned the operator that Mr. Arbery had a mental condition that had "escalated" over time. Additionally, Ms. Jones told the officer that Mr. Arbery might get violent with the officers due to his mental illness, if they were too confrontational with Mr. Arbery or tried to arrest him or take him into custody;
  5. On August 21, 2018, Burke County Witness reports and Burke County Office body cam Video reveals Mr. Arbery was caught by stay-at-home mom who saw him in her backyard looking into the windows of her cars. She called police who found Mr. Arbery at his grandmother's residence. Police officers arrived to give Mr. Arbery trespass warning about his conduct and behavior. When confronted by the officers about the eye-witness report, he lied said he had "gone running in the street," and then became aggressive, confrontational, and repeatedly threatened that he would "whip the officer's ass" if they didn't leave him alone. He was not arrested;

  6. On October 23, 2018, Burke County reports and Burke County officer body cam video reveal Mr. Arbery and two juveniles were confronted in vacant mobile home by the Burke County Sheriff's Office. Mr. Arbery ran when confronted by the authorities. He was later caught and lied, stating he was just out running, when asked about being in the mobile home. He was charged with misdemeanor obstruction for running when given lawful commands to stop;
  7. On December 1, 2018, Glynn County officer body cam video reveals Mr. Arbery was arrested, charged, and later convicted for felony shoplifting by entering store and attempting to steal television;
  8. In 2019 and 2020, witness interviews reveal Mr. Arbery was seen by his own neighbors, removing screen from windows and trying enter their homes through the windows. When confronted by the neighbors about his conduct and behavior, he appeared "nervous or agitated" and "trying to figure out where to go." Then he said he was interested in buy the house but "took off running." On the second occasion, the home owner observed Mr. Arbery trying to gain entrance through door. They again tried to talk to Mr. Arbery but he would not speak or say anything, he simply ran away;

  9. In 2019 and 2020, local convenience store witness interviews reveal Mr. Arbery became known as "the jogger" for his repeated conduct and behavior of running up, stretching in front in, and then entering several convenience stores where he would grab items and run out before he could be caught;
  10. In 2020, witness cell phone video reveals Mr. Arbery was confronted at convenience store by employees about his theft conduct and behavior. Mr. Arbery, cornered about his thefts, chose to fight a man who worked on location at the adjacent truck stop who tried to confront him about it.

The court documents also include the following about Ahmaud Arbery being seen several times on several surveillance cameras at night canvassing property and valuables:

  1. On October 25, 2019, home surveillance video at 220 Satilla Drive captures Mr. Arbery at night and in the dark canvassing the interior property and valuables contained within;
  2. On November 18, 2019, home surveillance video at 220 Satilla Drive captures Mr. Arbery at night and in the dark canvassing the interior property and valuables contained within;
  3. On February 11, 2020, witness testimony, 911 recordings, and home surveillance Video at 220 Satilla Drive details that Mr. Arbery was once again canvassing the interior and exterior property and valuables at night and that he fled after police were called.


District Attorney George Barnhill states the following as provided in the file AhmaudArbery_DistrictAttorney.pdf.
Note that the applicable Georgia Laws are given in bold text and clearly apply as cleary seen in the video evidence.

First,
I am the current elected District Attorney for the Waycross Circuit, I have worked as a criminal prosecutor for some 36 years. As an Assistant District Attorney in Waycross and Brunswick, as Chief Assistant in Waycross for 20 years and served as the District Attorney the last 5 years; I have been actively involved in over 100 murder cases and assisted other prosecutors with at least 100 more. I have no idea how many Aggravated Assault cases involving gunshots and wounds of all types; Plus I have attended countless schools, classes and seminars on criminal prosecution and criminal acts and evidence. Myself and one of my Senior Trial Attorneys have reviewed the evidence extensively and concur on all points.

Second,
As to the case at hand: It is my professional belief the autopsy confirms what we had already viewed as shown in the video tape, with the photographs & from the witness statements taken immediately at the scene. The autopsy supports the initial opinion we gave you on February 24th, 2020 at the briefing room in the Glynn County Police Department after reviewing the evidence you had at that time. We do not see grounds for an arrest of any of the three parties.

Third,
It appears Travis McMichael, Greg McMichael, and Bryan William were following, in 'hot pursuit', a burglary suspect, with solid first hand probable cause, in their neighborhood, and asking/telling him to stop. It appears their intent was to stop and hold this criminal suspect until law enforcement arrived. Under Georgia Law this is perfectly legal,

OCGA 17-4-60 "A private person may arrest an offender if the offense is committed in his presence or within his immediate knowledge. If the offense is a felony and the offender is escaping or attempting to escape, a private person may arrest him upon reasonable and probable grounds of suspicion."

Fourth,
It clearly appears Travis McMichael and Greg McMichael had firearms being carried in an open fashion. The investigation shows neither of them to be convicted felons or under felony supervision, they were in a motor vehicle owned by Travis McMichael. Under Georgia Law this is legal open carry.

OCGA 16-11-126
"a) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a weapon or long gun on his or her property or inside his or her home, motor vehicle, or place of business without a valid weapons carry license.
(b) Any person who is not prohibited by law from possessing a handgun or long gun may have or carry on his or her person a long gun without a valid weapons carry license, provided that if the long gun is loaded, it shall only be carried in an open and fully exposed manner."

Fifth,
The video made by William Bryan clearly shows the shooting in real time. From said video it appears Ahmaud Arbery was running along the right side of the McMichael truck then abruptly turns 90 degrees to the left and attacks Travis McMichael who was standing at the front left corner of the truck. A brief skirmish ensues in which it appear Arbery strikes McMichael and appears to grab the shotgun and pull it from McMichael. The 1st shot is through Arbery s right hand palm which is consistent with him grabbing and pulling the shotgun at the barrel tip, the 2nd and 3rd wounds are consistent with the struggle for the shotgun as depicted in the video, the angle of the 2nd shot with the rear of the buttstock being pushed away and down from the fight are also consistent with the upward angle of blood plume shown in the video and that McMichael was attempting to push the gun away from Arbery while Arbery was pulling it toward himself. The 3rd shot too appears to be in a struggle over the gun. The angle of the shots and the video show this was from the beginning or almost immediately became -- a fight over the shotgun. Given the fact Arbery initiated the fight, at the point Arbery grabbed the shotgun, under Georgia Law, McMichael was allowed to use deadly force to protect himself. Just as importantly, while we know McMichael had his finger on the trigger, we do not know who caused the firings. Arbery would only had to pull the shotgun approximately 1/16th to 1/8th of one inch to fire weapon himself and in the height of an altercation this is entirely possible. Arbery's mental health records & prior convictions help explain his apparent aggressive nature and his possible thought pattern to attack an armed man.

For the above and foregoing reasons, it is our conclusion there is insufficient probable cause to issue arrest warrants at this time.

Ahmaud Arbery's mother knew for a fact that her son was a convicted felon and thief and there is little doubt that she knew that he was stealing things from the neighborhood where he was seen on several security cameras prowling around at night within, and pretending to be "jogging" through during the day, while looking for more things to steal, precisely as stated in several previous police reports about Ahmaud Arbery getting caught trespassing.
Was Ahmaud Arbery's mother's home and his grandmother's home searched for stolen items from that neighborhood that he had no business being in?

Dear Mrs. McMichael:

I cannot imagine the pain, misery, and extreme frustration that all of you are experiencing after your son, husband, and Mr. Bryan were unjustly and cruelly prosecuted and imprisoned. My sincere heart goes out to each and every one of you.

The whole world clearly saw that those honorable gentlemen never ever even touched Arbery who chose to run to the left (instead of the right) and attack, beat, and FOOLISHLY try to take the loaded gun by the barrel away from Travis, which gave Travis no other option than to defend himself while being attacked and beaten and could have been murdered by his attacker.

Their case is virtually identical to that of Kyle Rittenhouse who was also attacked and beaten while his attackers also FOOLISHLY tried to take the loaded gun away from Kyle, which also gave Kyle no other option than to defend himself while being attacked and beaten and could have been murdered by his attackers.

In both cases those men were bravely fulfilling their responsibility to protect the community from dangerous criminals.
All reasonable people know EXACTLY why Kyle was found innocent but Travis, Greg, and Roddy were unjustly and cruelly found guilty (i.e. because Kyle's attackers were white but Travis' attacker was black, over which BLM riots, loots, and burns our cities if America does not cave into their ridiculous demands).

If I may, I would like to do what I can to help make life a little bit more tolerable for Travis, Greg, and Roddy.
For example, are there any books that they might enjoy reading or maybe magazine subscriptions?
Or, maybe model cars or boats that they might enjoy assembling, painting, and displaying?
Would they appreciate letters of support and encouragement?

I would like to personally attend any protests in support of Travis, Greg, and Roddy.
Are there Social Media pages or web sites that I can join that are in support of Travis, Greg, and Roddy?
Currently, whenever the subject is mentioned on any of the 20 most popular International and National Facebook News pages, I post comments in support of those honorable gentlemen.

Please extend my sincere respect, admiration, and appreciation to Travis, Greg, and Roddy for their brave and justified actions.
